Kocheras Home Terms of Use
These apply to Kocheras Home, household use between people who know each other. If you are signing up for a company, yours are the Kocheras Business terms.

In short
- Kocheras is a tool for organising vehicle turns between people who know each other.
- We don't own any vehicle, we don't rent cars and we are not an insurer.
- Each owner decides who uses their vehicle and is responsible for making sure their insurance covers it.
- Whoever drives is responsible for fines, damage and returning it on time.
- You can leave whenever you want, take your data with you and delete your account from within the app.
1. What Kocheras is and isn't
Kocheras lets a vehicle owner organise shared use: invite other people, approve bookings and record mileage, expenses and issues.
Kocheras is not a party to any agreement between the owner and the driver. We don't inspect vehicles, we are not assessors and we don't decide who should pay when there is a disagreement.
2. Your account
You must be of legal age and provide accurate information. You are responsible for your password and for what happens with your account.
We may suspend an account where there is reasonable evidence of fraudulent use, repeated non-payment or unresolved damage. We will tell you the reason.
3. Sharing a vehicle
The owner decides who to invite and what permissions to grant, and may withdraw access at any time. If there are future bookings, they are cancelled and the person affected is notified.
Anyone granted access agrees to:
- Drive with a valid, current licence.
- Respect the vehicle's rules (hours, maximum duration, prior approval).
- Return it at the agreed time and in the same condition.
- Record mileage and fuel level when asked.
- Report any damage or issue, with a photo where requested.
4. Insurance and liability
This is the most important section of this document.
Kocheras provides no insurance whatsoever. The only cover on a vehicle is whatever its owner has arranged.
It is the owner's responsibility to confirm with their insurer that their policy covers letting the people they grant access to drive the vehicle. A private policy may not cover third-party drivers, and is even less likely to do so where a price is charged.
The driver is responsible for traffic penalties, tolls and damage occurring during their use, unless the parties agree otherwise.
Kocheras is not liable for property damage or personal injury arising from the use of a vehicle managed through the app.
5. Paid rental
If charging for vehicle use is enabled in the future:
- The owner must expressly declare that their insurance covers letting the vehicle for a price.
- Income belongs to the owner, who is responsible for their own tax obligations.
- Kocheras may charge a service fee, shown before each booking.
6. Price, payment and withdrawal
Kocheras Casa is free for up to two vehicles, for good and with unlimited people. From the third vehicle on, each extra one is paid for.
- It depends where you subscribe. On
kocheras.appprices are shown before tax, which is why «+ VAT» appears next to each figure: whichever tax applies is worked out at checkout from the billing address and itemised on the invoice. In the iPhone app, the price you see already includes tax, because that is how the App Store charges. - There may be discount codes or promotions. They are entered when you subscribe and the screen states what discount they apply and for how long before you pay. A code does not change the list price and is never applied unless you type it.
- Payment is in advance, monthly or yearly, and there are two ways depending on where you subscribe:
- On
kocheras.app, by card and through Stripe. We charge you and we issue the invoice. - From the iPhone app, as an in-app purchase. In that case Apple is the seller: it charges you through your Apple ID, issues the receipt for that purchase and is the party that accounts for the tax. We do not issue an invoice for it; you will find the receipt in your Apple ID purchase history.
In neither case does Kocheras store your card number.
- You pay per active vehicle. An archived vehicle is not charged.
- Adding a vehicle is charged straight away, only pro rata for the rest of the current
period. Removing one is not refunded: the period is already paid for and you keep it
in full, and the reduction applies at the next renewal.
- You can cancel at any time, without calling anyone. If you subscribed on
kocheras.app, from the app itself. If you bought from the iPhone, the subscription is
cancelled in your Apple ID settings (Settings → your name → Subscriptions), because
Apple manages it. Either way the service runs until the end of the period already paid for
and the account returns to the free plan on its own.
- If a payment fails, it is retried automatically several times over a few weeks, and you are notified each
time. If it is still unpaid after that, access is blocked. No data is deleted: once
paid, everything is back where it was.
Right of withdrawal
As a consumer you have fourteen calendar days to withdraw from the contract without giving reasons, counted from the date of purchase. Who you ask depends on who sold to you: if you subscribed with us, write to hello@kocheras.app or cancel from the app and you will be refunded; if you bought from the iPhone app, Apple sold to you and you ask Apple, as explained at the end of this section.
At checkout you are asked to agree that the service starts immediately. If you agree and then withdraw within the fourteen days, you are refunded minus the part proportional to the time you used the service.
If you bought from the iPhone app, withdrawal is exercised against Apple, who sold to
you and holds the payment. Refunds are requested from your Apple ID purchase history at
reportaproblem.apple.com and are decided by Apple under its own terms. We cannot refund an
amount we never collected, but if you write to hello@kocheras.app we will tell you how to do
it and help with whatever depends on us. Your fourteen days and your rights as a consumer
are not lost: they are exercised against whoever sold to you.
7. Personal data
We handle your data as set out in the privacy policy: we use it to make the app work, we don't sell it, and you can download or delete it whenever you want.
8. Leaving and deletion
You can delete your account from Profile. Your personal data, vehicles and bookings are removed. Some information may be kept anonymised or where there is a legal obligation.
Deleting your account does not cancel outstanding debts between users.
9. Changes and governing law
We may amend these terms. Where a change is significant, we will show it in the app and you will need to accept it to continue.
Spanish law applies and, for consumers, the courts of their place of residence.
